Charlie Sheen’s neighbor WITHDRAWS no-contest plea on assault prices

The neighbor who attacked Charlie Sheen at his Malibu home is seeking to overturn the case, citing ‘incompetency’ despite previously pleading no contest.

Electra Poag Schrock, 48, is hoping to ‘clear her name’, DailyMail.com has learned, now claiming she was unfit to stand trial at the time, due to ‘mind-altering’ medications she was forced to take in custody following her arrest.

The blonde practicing Buddhist was accused of trying to strangle the TV star, 58, after he opened the door of his relatively modest second-floor apartment at the Malibu complex on December 20.

She is due back in court on Thursday.

Schrock, who was living in a rented two-bedroom unit on the third floor, was arrested that day and charged with ‘felony assault by means of force likely to produce great bodily injury’ over the altercation in the upscale star-studded California coastal enclave.

An initial charge of ‘assault with a deadly weapon with force’ was dropped.

Divorcee Schrock originally pleaded not guilty during her initial arraignment on December 26.

She changed her plea to no contest three weeks later and received two years of formal probation with conditional release to a residential treatment program for substance abuse for 90 to 120 days.

But in a court declaration last week, Schrock formally withdrew her plea, due to ‘pharmaceutical contraindications directly causing incompetency to stand trial’.

In the document, dated July 9 and obtained by DailyMail.com, Schrock states she suffered medication interactions – including ‘uncontrollable body convulsions and hallucinations’ – after being forced to take antipsychotic drugs while held in custody at the Century Regional Detention Facility in Lynwood, 14 miles south of downtown LA.

‘I was administered Haloperidol which caused my body to quickly develop severe uncontrollable body convulsions, also known as Parkinsonism, with mild hallucinations,’ she said in the declaration.

‘Refusal to take medication was not an option, for if I did not comply with Lynwood CRDF staff I was treated with indignity; remaining in [a] ‘suicide gown’ with my breasts exposed multiple times in Van Nuys Courthouse and Lynwood CRDF.’

On January 2, days before pleading no contest, Schrock says she then spoke to her public defender concerning the ‘graveness’ of her health and medication interactions, after which a health examination was requested.

According to the documents, Schrock was no longer taking Haloperidol by January 13, upon her ‘absolute refusal to continue causing my body unbearable amounts of strain and my mind to remain in an altered state.’

She claims that from then on she was unknowingly given anti-tremor drug Cogentin, causing her to develop ‘severe hallucinations restricting the ability to perceive reality logically and rationally’.

The administration of the drug continued until January 18 – the day before she signed her plea – ‘upon realization’ she had an allergy to the drug, the declaration states.

Schrock was released from custody on January 19 and entered a Los Angeles treatment facility.

‘Electra is hopeful the court will accept her plea withdrawal so she can have a chance to clear her name,’ a close friend tells DailyMail.com.

In the wake of the incident, prosecutor Nicole Flood told the court Sheen had been left ‘quite fearful’ following the altercation.

She also revealed Sheen had stitches on his body at the time, and during the tussle with Schrock one stitch had ‘come out.’

The Hollywood actor was granted a protective order requiring Schrock to stay away from him for 10 years.

Since completing 90-days of rehab on April 21, Schrock and a business partner have opened Malibu Castaway, a consignment store on the Pacific Coast Highway.

‘We hope to serve the Malibu community, as well as tourists and foreigners,’ Schrock told The Malibu Times.

‘Just like the people of Malibu, our store focuses on quality. Many locals here have treasures from all over the globe. Unique celebrity memorabilia as well as film scripts, books, and art.

‘We want people to feel confident and content casting off their well-heeled goodies.’

She added: ‘I was also in the news a while back regarding an incident with Charlie Sheen…that’s not this story though.’
