A ‘disgustingly drunk’ police officer sexually assaulted another woman after telling her ‘I know the law’, a court has heard.

A court heard Fiona Anderson, 33, got into bed with her alleged victim after the pair had been drinking together and performed non-consensual oral sex on her.

Anderson, a police constable with Devon and Cornwall Police, persisted after the woman said ‘I don’t want to have sex with you, you’re too drunk’, the jury heard.

Emma Martin, prosecuting, said Anderson sexually assaulted the alleged victim after she had gone to bed.

The naked police officer had tried to initiate a sexual encounter between them, the court heard, and stripped off the other woman’s underwear.

‘It was clear to Fiona, it was abundantly clear that (the complainant) did not want sexual contact with her,’ Ms Martin said.

‘Fiona, that night, drunkenly sexually assaulted (the woman).’

Despite the woman saying she did not want to have sex, Anderson proceeded to kiss and bite her, the court heard.

Ms Martin told Bristol Crown Court: ‘Fiona was becoming rougher with her, she pulled (the complainant’s) underwear off.

‘Fiona stripped off, she was completely naked,’ Ms Martin said.

‘She started trying it on but was told ‘You need to be quiet – shush, shush – I don’t want to have sex with you, you’re too drunk.”

But Ms Martin said the police officer ‘didn’t stop’, and became rougher with her.

The prosecutor told the jury: ‘At this point, (the complainant) says that Fiona said the words to her ‘I need you to say yes, I know the law, I need you to say yes’.

The alleged sex attack took place in 2018 in Cardiff, the court heard.

The jury jury heard how Anderson’s alleged victim had not been ‘reciprocating’ any of her advances as she was kissed. 

Ms Martin said the alleged victim was lying on her back when Anderson got on top and started to kiss her.

‘(The woman) really didn’t want to be kissed but it was pretty clear that Fiona wanted more than just kissing’, the prosecutor said.

‘She said the words ‘I really want to have sex’. ‘(The woman) completely froze. In her mind she had already communicated: ‘I am not interested in intimacy at the moment.’ 

‘Fiona, the prosecution say, literally pinned (the woman) by the arms on the bed. 

‘Kissing turned to biting. Fiona was performing oral sex without (the woman’s) consent.’ 

The incident ended when the woman continued to not say ‘yes’ and Anderson left the bedroom to vomit in the bathroom. 

The court heard Anderson’s memory of the evening was ‘a bit fuzzy’, but that she denied any non-consensual sexual activity with the woman.

Anderson , from Exeter, Devon, has been suspended from duty since her arrest in March 2023.

She denies two counts of sexual assault.
