Motorists may very well be performed for drink driving with out even getting behind the wheel

Motorists are being warned that they could face fines and points over Christmas for offences related to drink-driving without even driving their car.

If police think someone is drunk and about to drive away, it counts as an intention to drive while intoxicated should the breathalyser confirm suspected alcohol levels.

Even just sitting in your car with the keys in the ignition outside a pub could land you in trouble with the coppers, who might think you’re planning to take to the wheel after a few too many sherbets.

Legal experts at Swansway Motor Group are telling punters to avoid any grief and leave their keys at home during the party season to dodge the chance of being tempted to drive, reports Birmingham Live.

They’ve said: “Many people don’t realise that drink-driving laws in England go beyond just being behind the wheel. You can be charged with being ‘in control’ of a vehicle even if you’re simply standing near it while intoxicated.”

They added: “If the police believe you had the intention to drive – whether that’s by being close to the car, sitting inside it, or even having the keys in the ignition – you could face serious consequences. These include a fine of up to £2,500, three months in prison, or a driving ban.

“The legal definition of drink-driving is broader than most people think, especially during the festive season when incidents tend to rise.”
