A sex offender was caught with extreme pornography thanks to an app installed on his phone to spy on his activities. Daniel Rushton, 39, was handed a suspended sentence in 2023 after admitting attempting to engage in sexual communication with a child online.
But he was arrested again after software installed on his mobile phone as part of a sexual harm prevention order flagged three images depicting bestiality. Prosecutor James Kellam told Southampton Crown Court he made “comprehensive admissions” in interview.
In mitigation Jamie Riley, defending, told the court Rushton had given officers the passcode to his phone and no other indecent material was found.
He had completed the requirement of unpaid work from the previous sentence and probation officers had confirmed he had attended all of his appointments. Unemployed Rushton, who he said has learning difficulties, had also carried out a course at the end of last year to help him gain work.
He previously pleaded guilty to one count of possessing extreme pornographic images. A charge of breaching a sexual harm prevention order for a separate incident was withdrawn.
Judge Nicholas Rowland handed Rushton a 12-month-community order. He warned him: “It is a serious offence for anybody – let alone someone with your history.
“Continue with the progress you’re making, otherwise things will take a turn for the worse.” Rushton, of Totton, Hampshire, must also carry out 10 rehabilitation activity requirement sessions.
