Lindsay Clancy lawyer says he desires killer mom to face trial once more, as DA refuses to say refuses to say whether or not he’ll push for homicide costs once more: Live updates

Lindsay Clancy‘s lawyer demanded that the nurse mom face a retrial in the spring of 2027 at her court hearing today.

Assistant District Attorney Jennifer Sprauge told the judge the prosecution wants to wait until the judge rules on the motions and any possible appeals before setting a trial date. However, the office had not made a decision on charges.

‘Why do we not know if the next trial is going to be murder in the first degree or a lesser charge?’ Clancy’s lawyer, Reddington, hit out in court.

Clancy was charged with triple first-degree murder for the January 2023 killings of her children, five-year-old Cora, three-year-old Dawson and eight-month-old Callan.

She admitted to strangling the kids, but pleaded not guilty to murder by reason of insanity, saying she was suffering severe postpartum psychosis and was overmedicated by doctors.

Reddington calls out the District Attorney for not making a decision on what the retrial charges will be

ADA Sprauge told the judge the prosecution wants to wait until the judge rules on the motions and any possible appeals before setting a trial date.

Reddington called out the district attorney for not deciding what the retrial charges will be.

‘Why do we not know if the next trial is going to be murder in the first degree or a lesser charge? Why do they need to wait for the motions? I need to know logistically,’ he said.

Reddington said he would like Sullivan to judge the retrial and emphasized his client’s right to a speedy trial.

‘I want a trial, I want it with you, and I want it this spring,’ he said.

Lindsay Clancy prosecutors say they will retry her, but don’t know if she’ll face murder charges again

Lindsay Clancy’s future hangs in the balance as the prosecution refuses to say what charges she could face at a retrial.

The 36-year-old former nurse was back in a Massachusetts courtroom on Monday, where lawyers argued over motions to dismiss the case, investigate the holdout juror and place a gag order on the attorneys as she faces a retrial for the killings of her three children.

Sullivan asks attorneys to discuss a potential retrial date

Judge Sullivan told the lawyers, ‘There are two ways to handle things at this point: pick a potential trial date, or see what the outcome of the motions is, or pick a trial date so we have one on the docket.’

Attorney Laura McConnell argues against gag order for Clancy defense

Attorney Laura McConnell argued that the prosecution has failed to make its case for the gag order.

She said there is no proof that Kevin Reddington’s statements have affected a potential jury, and no new trial has been scheduled.

‘We don’t know if any potential juror has been affected by this,’ McConnell said.

‘I am not looking for 15 minutes of fame,’ prosecutor says

ADA Jennifer Sprauge argued for a gag order in the case.

‘I am not looking for 15 minutes of fame in the case,’ Sprauge said.

‘What the Commonwealth wants is justice for Cora, Dawson and Callan.’

Sprague accused Kevin Reddington of making ‘calculated [statements] to affect the public perception of this case.’

Court in recess

Judge Sullivan has called for a short morning recess.

When court returns, he will hear arguments over the gag order.

What REALLY went down in Lindsay Clancy jury deliberation room amid holdout drama, revealed by legal experts who predict what’s coming next

When the Lindsay Clancy trial ended in a mistrial, it seemed an inconceivable outcome for such lengthy and high-profile proceedings. That the jurors were locked 11-1 just added to the angst.

But as emotions have settled, they have been replaced by questions. Most notably: What happened in the Plymouth County deliberation room? And what happens next?

Exclusive:I defended a deranged mom who had killed her baby. The similarities to Lindsay Clancy are chilling

I’m no stranger to courtroom dramas.

I successfully defended Daniel Penny, the Marine veteran who was accused of recklessly choking to death a homeless Jordan Neely on a New York subway in May 2023.

And I spent a good part of a year in rural Alabama defending a man who shot his neighbor on his own front porch at 2am – a case in which the judge had already denied Stand Your Ground immunity. The jury was hung and the DA dropped the murder charge rather than try it again.

I had no way of anticipating that my first assignment on the homicide panel would be representing a 27-year-old Bronx woman accused of throwing her six-month-old daughter from the window of their high-rise apartment building in 2015.

Attorney for holdout juror addresses court

Holdout juror Michael Desronvil’s attorney is addressing the court.

Lawyer Heather O’Connor claimed the defense made no effort to follow up on his questionnaire.

‘We are here because Juror Doe did not vote the way the defense wanted,’ she argued.

Who is the holdout juror Michael Desronvil?

The lone holdout juror who refused to acquit Lindsay Clancy in the murders of her children has been identified as 48-year-old Michael Desronvil.

He has said he thought the mother of three was ‘methodical’ in the ‘execution’ during his first interview since the trial ended.

Desronvil faced allegations from Clancy’s attorney that he lied to the court about previous domestic violence allegations.

Kevin Reddington and Judge Sullivan argue over holdout juror in tense moment

Judge William Sullivan interrupted Kevin Reddington as he began making arguments about the holdout juror.

‘I’m going to stop you right there,’ Sullivan said.

Reddington replied, ‘No, you’re not going to stop me.’

Sullivan then threatened to end the hearing.

‘There’s no need to bring out that juror’s name,’ the judge said.

Reddington then argued the holdout juror ‘got more facetime than I do’ after speaking with the media.
